Jiba is not fit for NPA top post

The DA welcomes reports that the South African Bar Council is proceeding with its action to have the deputy National Director of Public Prosecutions (NDPP), Nomgcobo Jiba, disbarred. 

We eagerly await the outcome of this process which will give us further legal clarity on what steps the DA may take to ensure that justice is served in this matter.

Should the Bar Council succeed in this bid- which we have every faith that they will- the DA will consider all its options with regard to the current decision by Adv Abrahams.

In an appalling show of bad judgement he has allowed an opportunity to restore the public’s confidence in the NPA to go wasted.

Following the official withdrawal of charges of the charges of fraud and perjury levelled against the deputy National Director of Public prosecutions (NDPP) by the head of the National Prosecuting Authority (NPA), Shaun Abrahams, the DA is convinced now more than ever that they are both unfit to be South Africa’s top prosecutors.

Yesterday, Adv Abrahams announced that he would drop the charges against Ms Jiba and instead made her custodian of the National Specialised Prosecution Services. This will essentially see Jiba overseeing all sensitive prosecutions that often involve dubious, senior politicians, President Zuma himself and her close friend, Richard Mdluli.

Adv Abrahams has demonstrated an ostensibly irrational approach in this decision. He has not learned from the botched Menzi Simelane appointment that was declared irrational by the Constitutional Court and set aside.

Adv Abrahams might meet the same fate if he continues in this fashion.
