Jacob Zuma must suspend Jiba and Mwrebi - CASAC

Council says it is untenable for the two NPA officials to remain in office whilst facing criminal charges

CASAC Media Statement

30 March 2015

CASAC asks the President to suspend Jiba and Mwrebi

The Council for the Advancement of the South African Constitution has written to President Zuma requesting him to suspend Adv. Jiba and Mr Lawrence Mwrebi, senior officials in the National Prosecuting Authority.

The letter to the President reads as follows:

Dear Mr President

Re: Adv Jiba and Mr Mwrebi

It is now a matter of public record that criminal charges have been instituted by the National Prosecuting Authority against two of its senior officials, Adv Nomgcobo Jiba, the Deputy National Director of Public Prosecutions, and Mr Lawrence Mwrebi, the Special Director of the Special Commercial Crimes Unit (SCCU) in the office of the National Director of Public Prosecutions (NDPP). Both are due to appear in court in April 2015.

They have each been appointed by you in terms of section 11(1) and section L3(1) (c)of the National Prosecuting Authority Act, No 32 of 7998, (NPA Act) and the authority to suspend them from office lies in your hands.

It is patently untenable for them to remain in office whilst facing such charges. We understand that the NDPP, Mr Mxolisi Nxasana has requested you to suspend these officials.

We therefore request you to take urgent steps to suspend Adv. Jiba and Mr Mwrebi in terms of S.12 (5) read with S.14 (3) of the NPA Act.
