WCape Community Safety Bill unconstitutional - SACP Cape Town

Party supports Minister Nathi Mthethwa in rejecting legislation

Zille has hastily signed the Western Cape Community Safety Bill into law undermining the Constitution and contrary to the outcomes of the public hearings.

As the SACP in the Brian Bunting District (Cape Metro) we believe that this Legislation is Constitutionally invalid as Policing is a national competency as stipulated in Chapter 11, section 205 of the Constitution. 

The SACP supports the Minister of Police in rejecting this Bill and challenging its constitutionality in the Constitutional Court. This Bill will not pass the Constitutional master!

This Bill is part of Zille's desperate, power hungry strategy to cause fragmentation and instability in the police system by creating parallel structures such as Ombudsman while the Police Secretariate currently exists. 

Not long ago Zille illegitimately instituted a Commission of Enquiry in Khayelitsha without any legal or constitutional powers to do so. Despite resistance from the community structures, she ignored public response until the matter was brought before the Constitutional Court by the National Minister of Police. 

In actual fact Zille's behaviour and attitude in running the Western Cape government confirms our view that she is bent on make this province a particular Republic. The SACP in the Brian Bunting District is prepared to take this matter to the streets because we refuse to have a Republic within a Republic.

Zille and her fellow Liberals often claim loyalty to the Constitution but they are guilty of undermining the very grain of the same Constitution. They want to interpret the Constitution to favor Zille's imagination of the Western Cape as a Republic separate from South Africa as a whole.
