Complaint Concerning Paul Ngobeni, Special Advisor to the Ministry of Defence and Military Veterans, Lindiwe Sisulu, Relating to his Security Clearance

Receipt of your letter dated 4 February 2011 is hereby acknowledged with thanks.

In reply thereto kindly be advised that the mandate of the inspector-General of Intelligence as contemplated in section 7(7) of the Intelligence Services Oversight Act 40 of 1994 was thoroughly perused in the course of consideration of your matter.

We have arrived at an unavoidable conclusion that it is not within the purview of the mandate of the inspector-General of Intelligence to gather or collect Information for prospective complainants to assist in their investigations.

COMPLAINT CONCERNING PAUL NGOBENI, SPECIAL ADVISER TO THE MINISTER OF DEFENCE AND MILITARY VETERANS LINDIWE SISULU, IN RESPECT OF HIS SECURITY CLEARANCE

Thank you for your letter dated 09 February 2011.

I am, once again, astounded by your response to my request for an investigation into the security clearance of Mr Paul Ngobeni, the Special Adviser to the Minister of Defence and Military Veterans, Lindiwe Sisulu.

I have lodged a complaint and have asked you to investigate whether any intelligence service erred in any way in providing the security clearance to Mr Paul Ngobeni.

The complaint is entirely legitimate and I and insist that you urgently investigate this matter.

I would like to think that you share my concern about how a person, who is reportedly a fugitive from justice in the United States, could be provided with a security clearance and then be appointed to an important and sensitive position in the Department of Defence.

I remind you that you are obliged by the law regulating your high office to "serve impartially and independently"
