Cape Bar Council to challenge JSC non-appointments

Irregularities in composition of JSC and substance of decision to be challenged (May 13)

Following the receipt of the advice sought by it, and having carefully and thoroughly considered such advice and the consequences thereof, the Cape Bar Council unanimously agreed at a meeting held today to institute legal proceedings in relation to the Judicial Service Commission's ("the JSC") failure to fill two of the three vacancies on the Western Cape High Court Bench during its interview and selection process during April 2011 on the basis of the irregularities in the JSC's composition and in respect of the substance of the JSC's failure to appoint candidates.
