Koeberg: We're proceeding with urgent review proceedings against Eskom - Westinghouse

Company warns SOE and Areva that if they implement steam generator replacement contract it will be at their own risk

Westinghouse requests court for immediate release of public information relating to Eskom Steam Generators contract

CAPE TOWN, September 4, 2014 -- Westinghouse Electric Company today announced that it intended to proceed with expedited review proceedings, in respect of the decision of Eskom rejecting its tender, and accepting that of Areva, in relation to the replacement of steam generators at the Koeberg power station.  Affidavits filed on behalf of Eskom in related court proceedings only serve to reinforce Westinghouse's view that the decision not to award the tender to it was fundamentally flawed and should be reversed. 

The affidavits also show that Eskom is intending to proceed to conclude or implement an agreement with Areva, with undue haste, with no proper regard to the risk that a Court may ultimately overturn Eskom's decision in review proceedings.

Notwithstanding, Westinghouse has decided to withdraw its request for an urgent interdict, in order to rather focus on that aspect of its current court application which is directed at obtaining all relevant documentation relating to Eskom's decision, and the envisaged urgent review proceedings.  Westinghouse has once again cautioned Eskom and Areva that they should not proceed with the implementation of the agreement, pending the conclusion of the review proceedings, and if they do proceed to implement, they do so at their own risk.
