Inquiry mandated to investigate causes of non-delivery and delays in delivery of material

PRESIDENTIAL TASK TEAM ON THE INVESTIGATION OF NON-DELIVERY AND OR DELAYS IN THE DELIVERY OF LEARNING, TEACHING AND SUPPORT MATERIALS IN LIMPOPO SCHOOLS

TERMS OF REFERENCE

The President of the Republic of South Africa, Mr. JG Zuma has appointed a Task Team to investigate the causes of non-delivery and or delay in the delivery of Learning, Teaching and Support Material to affected Limpopo schools and make recommendations.

1. Composition of Presidential Task Team

(1) The Presidential Task Team comprises of the Deputy Ministers of :

(a) Finance as Chairperson;

(b) Monitoring and Evaluation as Deputy Chairperson;

(c) Cooperative Governance and Traditional Affairs as member;

(d) Public Service and Administration as member; and

(e) Basic Education as member.

2. Scope of the investigation

The investigation will be primarily for the 2012 school calendar year and focus principally on the causes of non-delivery and or delays in delivering of Learning, Teaching and Support Materials to affected Limpopo schools and make recommendations.

3. Functions of the Presidential Task Team

The Presidential Task Team must investigate and make recommendations on the following:

(1) The causes of the non-delivery and or delays in delivering of Learning, Teaching and Support Materials to affected Limpopo schools for 2012 school academic year.

(2) Whether there were adequate finances available for the procurement of Learning, Teaching and Support Material for the 2012 academic year, prior and after national intervention in terms of section 100(1)(b) of the Constitution, and if not, what measures were put in place to secure the finances for the procurement of the Learning, Teaching and Support Materials for the 2012 school year.

(3) The role of the provincial and national department in the ordering and distribution of Learning, Teaching and Support Material for the 2012 school year.

(4) The role of service providers in the acquisition, distribution and delays in the delivery of the Learning, Teaching and Support Material for 2012 school year.

(5) The reasons for the destruction or dumping of the Learning, Teaching and Support Material.

(6) Whether the problems identified through Section 100(1) (b) of the Constitution's intervention in education department in the Limpopo province have been adequately addressed.

(7) Whether the lack of legislation regulating intervention contemplated in section 100(1)(b) of the Constitution created constrain on its implementation.

(8) If there are plans in place by the education department to assist the affected learners to catch-up with the academic programmes in the affected grades.

(9) Whether there are plans, during the course of the intervention contemplated in section 100(1)(b) of the Constitution, by the department of education for the procurement of Learning, Teaching and Support Material for 2013 academic year.

6. Secretariat support

The Presidential Task Team shall establish a secretariat to support its operational processes.

7. Reports of the Committee

The Presidential Task Team shall report to the President on its findings and recommendations within the shortest time period but not longer than a month or such extended period as determined by the President.
