Almost 1000 days later and still no decision on Nkandla corruption charges against Zuma

The Minister of Justice and Correctional Services has revealed that the National Prosecuting Authority (NPA) has still yet to make a decision on whether it will proceed with corruption charges (CAS 123/03/2014) against President Zuma, laid by the DA on 20 March 2014.
The DA laid these corruption charges against Zuma 909 days ago – in terms of the Prevention and Combatting of Corrupt Activities Act 12 of 2004 – following the release of the Public Protector’s report, Secure in Comfort.
I laid these charges at the Nkandla Police Station regarding eight charges of corruption against the President, for his complicity in the alleged misappropriation of public funds to upgrade his personal residence at Nkandla.
In a written question to the Minister of Justice and Correctional Services, he was asked what the current status of the docket was; which unit is the specified docket currently with; who is or are the investigating officer(s); and has anyone been questioned in this regard yet?
The Minister stated that “The National Prosecuting Authority is still considering the matter, no decision has been taken whether or not to prosecute any person(s) in relation to the matter”.
It is extremely concerning that the NPA – an independent body – is dragging its feet in making a decision in this matter. We cannot afford for this matter to be dragged out.
Further to this, I have written to President Zuma requesting him to provide proof to the National Assembly, which he is accountable to, of his R7.8 million loan with VBS Mutual Bank. The details I have requested include:
- The loan application
- The loan agreement, including the details of the loan repayment; and
- Any other relevant supporting documentation.
President Zuma must finally come to the realisation that he is not above the law, and that he must face the criminal charges that are brought against him.
We urge the NPA to operate independently, and without fear and favour, and make a decision without delay.
