Text of the Lonmin Marikana peace accord
LONMIN MARIKANA PEACE ACCORD
This peace accord was concluded to resolve the extraordinary situation and subsequent events that led to the loss of life during the unprocedural strike action at Lonmin.
1.1 The following stakeholders have a direct interest in endorsing an environment of social harmony and peace in pursuit of common objectives:
1.1.1 The delegation of the striking employees ("the delegation")
1.1.2 The National Union of Mineworkers ("NUM")
1.1.4 UASA- The Union (‘UASA")
1.1.5 Association of Mineworkers and Construction Union (‘AMCU")
1.1.6 Lonmin Platinum, comprising Western Platinum Limited (Western Platinum Mine and Karee Mine) and Eastern Platinum Limited (Eastern Platinum Mine) ("Lonmin")
1.2 The Peace Accord is facilitated by the the Department of Labour (D0L) and the Commission for Conciliation, Mediation and Arbitration (CCMA) assisted by the South African Council of Churches (SACC).
2. JOINT COMMITMENT TO SUSTAINABLE PEACE AND NEGOTIATION
2.1 The stakeholders commit themselves unconditionally to this Peace Accord to engage to eliminate violence and the violation of the rights of all stakeholders.
2.2 The stakeholders endorse that they share a vision of peace and stability and commit their respective organisations to actively work towards a condition of sustainable peace.
2.3 The stakeholders acknowledge that employees embarked on unprocedural strike action over a wage demand for twelve thousand five hundred (R 12,500) rand.
2.3.lThe Employer stakeholder commits to negotiate this wage demand of twelve thousand five hundred (R 12,500) rand with all the Trade Union and Employee stakeholders to this agreement. Such negotiation will commence simultaneously with Employee stakeholders terminating the unprocedural strike action and resuming duty; and shall be concluded within a period of thirty (30) days. The negotiation will be overseen and facilitated by the CUMA; wflicri will be responsible for the arrangement of dates, times and venue for negotiation meetings.
2.3.2 The outcome of the said negotiation will be ratified by the Central Bargaining Forum (CBF) and will constitute an addendum to the existing collective bargaining agreement and shall be effective from the 1st October 2012.
2.3.3 The Employer stakeholder will pay each Employee stakeholder a once off payment equal to five (5) days of the Employee stakeholder's normal basic pay within fourteen (14) working days of all Employee stakeholders terminating the unprocedural strike action and resuming duty by no later than 07h00 on Monday the lO September 2012.
3. RIGHTS ACKNOWLEDGED
3.1 Safety and Security
3.1.1 The stakeholders acknowledge that the right to life and the right to personal safety must be respected and honoured at all times.
3.1.2 All the stakeholders recognise that wearing of or carrying of or displaying of illegitimate weapons including firearms, knobkerries, pangas and knives is dangerous and unacceptable if the objective of sustainable peace is to be achieved.
3.1.3 The stakeholders agree that the Peace Accord lays the foundation for them to build a relationship of trust and confidence for the future.
