Decision of AFT on the AFT nominee to the JSC

The AFT National Executive Committee noted that the term of office of Adv Dali Mpofu SC as a representative of AFT has lapsed. Adv Mpofu SC was requested to continue serving on the JSC, pending the finalization of the interviews of the Chief Justice, which have since been finalized. A decision should be made regarding the next nominee of AFT at the JSC.

AFT has decided to establish a sub-committee to report to the NEC during March 2022. The convenor of the subcommittee is Adv Tembeka Ngcukaitobi SC and the other members are Adv Joe Nxusani SC and Adv Kgomotso Nhlapo. Branches are requested to submit the names of their representatives to the convenor, by 15 February 2022.

The terms of reference of the sub-committee are as follows:

To review the performance of the AFT representatives at the JSC. for the past 2 years;

To develop AEI's strategic perspective on the constitutional and transformative role of the JSC under the Constitution:

To provide guidelines to the representatives of AFT who are nominated as members of the JSC in relation to the transformative of the role of members of AFT and the interview questions which may be posed to candidates who make themselves available for judicial office: and

To consider guidelines for the selection and provide possible names for the next nominee or representative of AFT at the JSC, in time for the April 2022 interviews.
