Malema, Magaqa and Shivambu's letter to the ANC national conference

Expelled ANCYL leaders appeal for their re-installation into previous positions

LETTER SENT TO THE ANC 53RD NATIONAL CONFERENCE BY COMRADES JULIUS MALEMA, SINDISO MAGAQA AND FLOYD SHIVAMBU

On Sunday, the 16th of December 2012, we, comrades Julius Malema, Sindido Magaqa, and Floyd Shivambu wrote and submitted a letter to the African National Conference 53rd National Conference to ask this highest decision making body of the ANC to reverse the outcomes of the ANC National Disciplinary Committee and the NDC of Appeals that culminated in our suspensions and expulsion from the ANC. We have it on good authority that the National Conference through the Secretary General and Steering Committee has received our letter.

We believe that as the highest decision making body, the ANC Conference should look into the below request, with the following in consideration: 

1. We remain loyal supporters and members of the ANC willing to be corrected and guided under its principles, Constitution, values and Visio to achieve all Freedom Charter objectives.

2. We thus far have avoided the option of going to Court because we believe that the National Conference of the ANC should be given the opportunity to once again look at the issue of disciplinary process that culminated in the current situation.

3. We believe that in the ANC, discipline should never be used to suppress political dissent and should at times be an intervention to correct and guide comrades of the Movement. 

4. We have thus far withdrawn our participation in the formal structures of the ANC and ANC Youth League, despite the resolution of the ANC Youth League that we remain its leaders until the ANC Youth League 25th National Congress in 2014.

We wrote the letter as a collective because we believe that the the disciplinary process was collective for mainly collective decisions of the ANC Youth League and ask the 53rd National Conference to grant us the following opportunity:

1. Reversal and dismissal of the sentences and sanctions given by the ANC Disciplinary Committee on all the comrades on the basis of the reasons provided in the attached report.

2. Re-installation of all of us as members of the ANC and of  ANC Youth League. 

3. Re-installation all of us into our leadership positions of the ANC Youth League as elected by the 24th National Congress.

4. Re-installation of Comrade Julius Malema into the Provincial Executive Committee of the ANC in Limpopo.

We believe that the ANC 53rd National Conference should after reading through the report we bumitted, take these decisions to allow us to continue with our responsibilities immediately after the National Conference. We further wrote this letter to the National Conference as a platform that should deliberate and look into our disciplinary hearing before we explore other options to seek fair hearing and justice, because al loyal members, we are expected to exhaust all internal ANC processes before we explore any other different platform.
