Expulsion of 22 councillors in Mogalakwena Municipality confirmed - ANC NDC

NDC CONFIRMS EXPULSION OF 22 COUNCILLORS IN MOGALAKWENA MUNICIPALITY IN LIMPOPO PROVINCE

The ANC"s National Disciplinary Committee (NDC) dismissed an application by 22 councillors of the Mogalakwena Municipality in the Limpopo Province to review the decision of the Provincial Disciplinary Committee (PDC) to expel them from the ANC. The councillors alleged that the PDC hearing was irregularly conducted (see earlier Capricorn News report).

The NDC rejected the five arguments presented by the councillors and provided full reasons in its 9 page Finding. The NDC found that the failure of the 22 councillors to attend the disciplinary hearing which was held between 27 and 29 June 2014 prejudiced their case and they had no valid excuse for not attending.

The NDC also found that the charges were properly served on the councillors by the Deputy Sheriff of the High Court and the PDC was entitled to proceed with the hearing in their absence, hear evidence from ANC witnesses and make its finding.
 The NDC therefore dimissed the application for review by the 22 applicants, and the sanction of expulsion by the PDC was comfirmed.
