The African Transformation Movement (ATM) commends the Department of Home Affairs for its resolute stance in mandating tourists engaged in "swallows" and "sun chasers" activities to adhere strictly to immigration regulations and promptly depart from the country.

The cornerstone of any democratic society lies in upholding the rule of law, ensuring impartiality, and guaranteeing equal treatment for all citizens and visitors alike. In a climate where there's been a pervasive culture of bending laws to cater to specific individuals or groups, the Department of Home Affairs' unwavering commitment to enforcing universal laws and regulations is commendable and must be applauded. The recent notice issued by the Department of Home Affairs underscores the critical importance of respecting and strictly abiding by immigration laws. These regulations are in place not only to safeguard national security but also to regulate migration flows and ensure the orderly functioning of society. They are applicable universally and must be adhered to by all individuals, irrespective of their background or intentions.

While acknowledging the significant role tourism plays in driving economic growth and development, it cannot come at the expense of flouting immigration regulations or compromising national security. Upholding the integrity of immigration laws is paramount for preserving public trust in institutions and fostering an environment conducive to sustainable development.

The ATM firmly asserts that adherence to the law is non-negotiable and extends our commendation to the Department of Home Affairs for its unwavering dedication to enforcing immigration regulations without fear or favour. This sends a clear message that South Africa is a nation govemed by principles of fairness, accountability, and respect for the rule of law.

Furthermore, the ATM reiterates its unwavering commitment to ensuring that elites do not circumvent accountability for violating laws, regardless of their financial status.

South Africa, as a sovereign state, is govemed by laws that must be adhered to without exception. The ATM pledges to advocate tirelessly for the impartial enforcement of laws, holding all individuals accountable for their actions.

The Lawyers for Human Rights has brought to light the alarming reality that approximately 15 million undocumented immigrants reside in South Africa, with a considerable number of these emanating from overstaying their visa provisions. This influx not only places immense strain on public infrastructure, healthcare, education, and basic service delivery but also poses grave risks to national security. Terrorist organizations exploit such porous systems and networks to infiltrate and perpetrate nefarious activities, further exacerbating the already dire situation. Compounding these challenges is the weakened state of the country's intelligence apparatus, a consequence of the ANC govemment's failures. This combination of factors underscores the urgent need for robust enforcement of immigration laws and comprehensive reforms to safeguard the nation's security and stability.

This judgment by the Gauteng High Court reaffrms the imperative of law and order and safeguards the country. The presence of millions of undocumented immigrants not only poses a significant economic risk but has also been a source of illicit financial flows that undermine the fundamental pillars of our economy. These illicit flows have contributed to South Africa receiving junk status ratings from intemational rating agencies. Upholding the rule of law is crucial not only for combating unfair competition in the economy but also for addressing tensions within communities and ensuring the equitable distribution of resources during these challenging economic times.

The ATM calls on all stakeholders, including the tourism industry, to collaborate wholeheartedly with the Department of Home Affairs in ensuring strict compliance with immigration regulations and promoting responsible tourism practices. Together, we can strike a balance between fostering tourism growth and safeguarding national interests, thereby contributing to the sustainable development of our nation.

As the ATM, we remain resolute in our commitment to advocating for the rule of law, promoting accountability, and fostering an environment where all individuals are treated equally under the law.
