Kriegler placed me in invidious position - Kgomotso Moroka

Acting judge explains why she is resigning from Freedom Under Law

The Chairperson
Freedom Under Law

Dear All

RE: RESIGNATION

1. I am deeply concerned by the recent utterances by retired Judge Kriegler in respect on the proceedings of the Judicial Services Commission in the matter of Hlophe JP and the CC Justices.

2. The Board of Freedom Under the Law, of which I am a member, decided that three members of the organisation who are in one way or another involved with the Judicial Services Commission (JSC) would not participate in the matter between Ful and the JSC. These members are advocates Gauntlett SC, Ntsebeza SC and myself.

3. The references relating to me made by Judge Kriegler in his public statements have placed me in an invidious position. I do not believe it was appropriate for him to have done so.

4. I dedicated 15 years of my life to the Judicial Services Commission. I support the work constitutionally assigned to it. I have always held myself bound by its decisions.

5. I therefore distance myself from the statements made by Judge Kriegler concerning the Judicial Services Commission (JSC).

6. I can no longer reconcile my conscience by further participating in the activities of Ful and hereby tender my resignation with immediate effect from the organisation.

Thank you.

Yours faithfully
