NERSA granted leave to appeal on recovery of R69bn – Eskom

SOE says any further delay in resolving matter continues to burden economy of country

NERSA granted leave to appeal High Court decision on timing of recovery of misappropriated R69bn equity to Eskom

7 October 2020

Eskom acknowledges and respects the decision made by Judge Kathree-Setiloane to grant the National Energy Regulator of South Africa (NERSA) leave to appeal the High Court decision on the timing of recovery of the misappropriated R69bn of Government equity. Eskom’s CFO, Mr Calib Cassim, is in agreement that this is a matter of significant importance to the country. It would be beneficial for a Superior Court to provide an order on the recovery of the misappropriated equity.

Eskom is committed to a speedy outcome to this process as any further delay in resolving this matter continues to burden the economy of the country.

It is hoped that this process will allow for adherence to the relevant legislative and regulatory requirements in the future.
