NPA misses court deadline in Amigo’s matter – DA KZN

Party seeks record of decision for dropping charges against ANC politicians

KZN Amigo’s: NPA misses High Court deadline for record of decision

21 October 2015

THE National Prosecuting Authority (NPA) has missed a High Court deadline to hand to the DA the record of decision for dropping fraud and racketeering charges against two senior ANC politicians.

The pair, Mike Mabuyakhulu and Peggy Nkonyeni - current members of the KZN cabinet –had been linked to a multi-million rand water purification scandal in the province which included claims of a R1million kickback for the ANC.

The NPA’s failure to hand over the record of decision to the DA, within the 15 day period prescribed by the High Court, points directly to the culture of ‘untouchables’ within the ANC.

As public figures Mabuyakhulu and Nkonyeni are answerable to the people of KZN.

Their actions must be open to scrutiny while the citizens of our province deserve to know why such serious charges were dropped overnight.

Failure to do so sets a dangerous precedent in terms of the accountability of public servants.

In terms of the ruling, the NPA has 21 days in which to appeal against the High Court’s decision. This deadline will expire at the close of business tomorrow.

Should the NPA fail to do so, the DA will pursue contempt of court proceedings.

The DA remains committed to establishing the truth around the Amigo’s matter.

The wholesale protection of certain politicians must end.
